2016 Pacifica Delegates Elections Ballots Recount Report

INTRODUCTION

The results of the 2016 Pacifica Delegates Elections were certified by TrueBallot, Inc. in October, 2016. Comprehensive recounts of the ballots using Pacifica’s licensed copy of ChoicePlus Pro (versions 2.3.2 and 2.3.4) have since been conducted by Terry L. Goodman, an experienced Pacifica elections teller.  Although some serious problems were identified, the recounts essentially confirmed the accuracy of the certified results.  Additional alternates were identified in several of the elections, although the eligibility of some write-in candidates has still not been confirmed.

RULES CONTEXT

With the adoption of new bylaws in 2003 in settlement of multiple lawsuits, the Pacifica Foundation became a membership corporation comprised of two membership classes. Voters in the Listener-Sponsor and Staff member classes from each of five radio station areas periodically elect Local Delegates, and these Delegates annually elect most of the Foundation’s Directors. Proportional representation through a Single Transferable Voting methodology (STV) is used in the election of station area Delegates. The Pacifica Bylaws include definitions of the member classes, eligibility and term limit rules, and an election timeline, mostly in Articles Three and Four.  The voting methodology is detailed in Article Fifteen.  For rules not specified by statute or bylaws, Pacifica’s parliamentary authority as specified in Article Sixteen is Robert’s Rules of Order Newly Revised, as periodically amended.

DELEGATE ALTERNATES

Pacifica’s bylaws do not specify any minimum level of voter support required for election as a Delegate.  Its STV rules prioritize the filling of all available seats, such that a candidate may theoretically be elected who has received zero votes.  Moreover, the defeated candidates in each Delegates election are retained as a pool of alternates used for the filling of future Delegate seat vacancies that may occur between scheduled elections (see Article Four, Section 10). When an alternate is seated, he or she inherits the term of the Delegate who he or she has replaced and serves out the remainder of that term.

WRITE-IN CANDIDATES

Pacifica’s bylaws do not clearly specify that nomination is required for election as a Delegate, and its parliamentary authority clearly allows election via write-in votes without nomination, provided that any such write-in candidate is eligible for election. As described above, the alternate pool is used to fill Delegate vacancies as they arise, and this includes unelected write-in candidates — even those with a single last-place ranking on a single voter’s ballot. Nominated candidates are presumably vetted by Local Election Supervisors in cooperation with station membership departments to confirm their eligibility for election in the membership class in which they were nominated.  When a voter exercises his or her right to write-in the name of a person not nominated, however, this bypasses the usual candidate eligibility check by election supervisors. Absent ready access to the confidential membership rolls as they existed on the election record date, the eligibility of write-in candidates cannot be confirmed.

RECOUNT CHRONOLOGY AND AUTHORITY

In its initial tallies for the 2016 Pacifica Delegates elections, TrueBallot aggregated all the write-in votes of each election into single virtual candidates.  If the virtual candidate was eliminated with all write-in votes combined, then it was clear that no individual write-in candidate had obtained enough votes to be elected in the contest and that all write-in candidates would be eliminated by the final tally round.  If the virtual candidate could achieve election, then the write-in candidates with the most chance of achieving election were disaggregated from the virtual candidate to see exactly how well the individual candidate did.  The partial disaggregation of write-in votes was adequate to determine the winners in each election; but, since all write-in candidates eligible for election in the Pacifica Delegate contests presumably qualify for inclusion in the corresponding Delegate alternate pools, full disaggregation of the write-in candidates should have been required of the election vendor.

2016 PNB Secretary Janet Kobren identified various anomalies in the preliminary election results from TrueBallot and/or the National Election Supervisor and brought these to the attention of the Pacifica National Board, which in a motion adopted on December 13, 2016 authorized the National Elections Supervisor to arrange a recount.  On December 20, 2016, Lydia Brazon, Pacifica’s interim Executive Director, authorized 2016 PNB Secretary Janet Kobren to gather membership status and membership class verification information from the station General Managers to help identify which write-in candidates were eligible for election in each contest and which were not.  On January 5, 2017, Secretary Kobren produced an initial analysis of ballot write-in data received from the election vendor demonstrating that the Delegate alternates pools were incomplete.  She subsequently produced an updated version on January 20, 2017, with additional information provided by station General Managers.

On January 5, 2017, the PNB directed the public posting of ballot data and authorized the iED to solicit assistance from a balanced team of volunteers to reprocess the votes.  On January 12, 2017, the PNB authorized iED Brazon to contract with someone to perform a recount of the 2016 Delegates elections ballots, with all valid write-ins disaggregated. Terry Goodman contacted iED Brazon with an offer of volunteered services in response to the January 12th PNB motion.

PROBLEMS AND SOLUTIONS IN THE RECOUNT PROCESS

In December, 2016, the election services vendor, TrueBallot, Inc., mailed the 2016 PNB Secretary the original paper ballots, web ballot data, and paper ballot images.  In examining ballot data for the recount, it became apparent to the Recount Teller that through an apparent Optical Character Recognition (OCR) template configuration error, data beyond the sixth ranking on the paper ballots had been ignored in every TrueBallot-tallied 2016 Delegates election.  Although a rescan of the paper ballots with corrected OCR templates was the most efficient route to correction, individual examination of all ballot images allowed for the human interpretation of unexpected ballot markings relevant to a correct understanding of voter intent, so the latter method was used by Goodman in crafting amended input files for the recount tallies. One of the most common errors encountered on paper ballots was the failure of the voter to fill in a ranking column bubble on the row corresponding to one or more write-in candidate names.  On the presumption that a voter would not bother to write-in a person’s name unless his or her intent was to rank the candidate so identified, unranked write-in candidates were assigned a ranking in this recount, typically a ranking immediately following that of the last ranked candidate on the voter’s ballot.  Where a voter indicated a ranking number next to a candidate name outside the scanned territory of the ballot, the voter’s indicated intent was recognized and followed in the recount.

Multiple last-place ties among write-in candidates were encountered in the WPFW Listener Sponsor Delegates election and a single last-place tie was encountered during the WBAI Staff Delegates election.  These ties were resolved randomly by the tally software.  Being random, a different resolution may be encountered in a subsequent re-tally.

The last problem in finalizing the recount results is in the qualification or disqualification of various write-in candidates.  A help request was sent to outgoing iED Brazon on February 10, 2017 and to incoming iED Bill Crosier on February 11, 2017; but these requests were likely ignored during the iED transition.  A spreadsheet from TrueBallot was obtained that showed a longer list of “eligible” alternates than was published by the National Elections Supervisor on the Pacifica Elections website, but no details of how eligibility was determined were included.

Most of the January 2017 information from station subscriptions departments, as relayed to 2016 PNB Secretary Kobren by station General Managers, has been incorporated into this recount.  However, where a station database manager reported that a 2016 Local Station Board Member was not a Pacifica Member on the election record date, that determination was presumed in this report to be an error caused by the non-reporting of some or all qualifying governance-related volunteer labor (see Pacifica Bylaws Article Three, Section 1(A)(2)).

Through consulting a voter database received from TrueBallot, Inc., examining the list history of Pacifica governance volunteers maintained at the Pacifica Meeting Calendar website (http://kpftx.org/pacalendar), and reviewing correspondence with the 2016 PNB Secretary who maintained the 2016 Delegates list data, the Recount Teller was able to verify the eligibility or ineligibility of most of the 186 unique write-in-only candidates in the five Listener Sponsor Delegates elections and all of the 44 unique write-in-only candidates in the five Staff Delegates elections.

In the opinion of the Recount Teller, candidates listed in this report as ELECTED or DEFEATED in a particular contest were eligible for election in that contest. In the opinion of the Recount Teller, candidates listed as EXCLUDED in a particular contest were not eligible for election in that contest.  The reasons for candidate exclusions are summarized in headings above corresponding .EXCLUDE-CANDIDATE commands in one of the ChoicePlus Pro input files which accompany this report.  In most but not all cases the candidate exclusion reason is additionally indicated by a two-character code inserted in front of the candidate’s name.  It was assumed that the candidates whose names appeared on printed ballots in these elections were verified by a Local Election Supervisor as eligible for election.  A final request for outstanding eligibility verification information on 24 write-in candidates went out to General Managers in early April, 2017, but no new information was received. In the event of a future Delegate vacancy for which a 2016 Delegates election runner-up will be offered a seat, unverified candidates (flagged as “NV” in these results) should be excluded unless proof of eligibility is provided.

Whereas, the certified results of the 2016 Pacifica Delegates elections do not include complete sequential listings of runner-up candidates for use in the filling of Delegate vacancies as they may occur;

And Whereas, on December 13, 2016, the PNB authorized that a recount of the 2016 Delegates election ballots be conducted, mostly due to irregularities in the handling of write-in votes;

Be It Therefore Resolved, that the alternate lists provided by the Recount Teller in his “2016 Pacifica Delegates Elections Ballots Recount Report” dated July 22, 2017 are approved for use in the identification of eligible alternates for the filling of delegate vacancies in each station area until the next delegates election is completed in that station area, provided that any runner-up so identified must be eligible in the membership class of the vacancy at the time of appointment as well as having been eligible in that membership class on the record date of the original election.

Be It Further Resolved, that the “2016 Pacifica Delegates Elections Ballots Recount Report” and its accompanying data files shall be distributed with this PNB Resolution to Local Station Board Secretaries for their reference and shall be posted for download on the 2016 Pacifica Elections website.

NOTES ON ATTACHED FILES

To save space, the 2016 ballot images are not attached.  At the moment, they are downloadable from http://elections.pacifica.org/documents/ballots.  The links there may disappear in preparation for the next elections.

The KPFA Listener-Sponsor Delegates Election input file (for example) is in the attached zip file under

\KPFA\Choice Plus\Listener\KPFA-Listener.in.  This is a plain text file, so it may be renamed to KPFA-Listener.txt for convenience.  In the same folder are the round-by-round reports in HTML format, and the KPFA-L Detail Report, mostly included in the KPFA section of this Report.

Ballot images that were unreadable in the data received from TrueBallot have been recovered and are found (for example) in \KPFA\TrueBallot\Recovered Images.  Also in each station area’s TrueBallot folder are the original TrueBallot lists of runners-up, which are missing several write-in candidates.
